Stufflet is a marketplace that connects people who own tools and equipment ("hosts") with people who want to rent them ("renters"). Stufflet is not a party to any rental, does not own or inspect any tool, and does not provide insurance. These terms govern your use of stufflet.com and the Stufflet apps. By creating an account you agree to them.

1. Who can use Stufflet

You must be at least 18 years old and able to enter into a binding contract. You must provide accurate information, keep your account secure, and tell us promptly if you believe it has been compromised.

We may require identity verification, a payment method on file, or a minimum rating before you can rent certain tools. Hosts set their own renter requirements within the limits of these terms.

2. Stufflet is a marketplace only

Stufflet is an intermediary. It provides listings, search, booking, payment processing through Stripe, messaging and a handoff record. Every rental is a contract solely between the host and the renter. Stufflet is not a party to that contract and not a rental company. At checkout the host is identified as the party you are renting from.

When a renter pays through Stufflet, Stufflet collects the payment as the host’s limited payment collection agent. Payment to Stufflet is treated as payment to the host, and the host’s obligation to deliver the rental is not Stufflet’s obligation.

Stufflet does not own, hold, inspect, maintain, transport, insure or operate any tool. Stufflet does not verify that any tool is safe, legal, accurately described or fit for any purpose, and does not supervise how tools are used. Listings, ratings and verification badges are information supplied by members and are not endorsements or guarantees by Stufflet.

Stufflet is not an insurer and does not sell, arrange or provide insurance, protection plans, damage waivers, warranties or guarantees of any kind to hosts or renters. No statement on the platform should be read as coverage.

3. Host responsibilities

By listing a tool you confirm that you own it or have the owner’s permission to rent it, that it is in safe working condition and complies with applicable law, that the listing is accurate, and that you have disclosed every known defect and hazard. You must provide the manufacturer’s instructions or equivalent safety guidance and any required safety equipment at pickup.

Your tools remain your responsibility and your risk. You are responsible for carrying any insurance you consider appropriate for lending your equipment to others. Many home and tenant policies exclude rental activity; check with your insurer before you list.

4. Renter responsibilities

By booking a tool you confirm that you are competent to use it, that you will use it only for its intended purpose, in accordance with the manufacturer’s instructions and applicable law, and with appropriate protective equipment. You may not let anyone else operate it.

You are responsible to the host for the tool from the moment you take possession until the host confirms its return: for damage beyond normal wear, for loss and for theft. You must return it on time, in the condition you received it, with all accessories listed.

5. Bookings, pricing and fees

A booking is a request until the host accepts it. Hosts have 24 hours to respond; unanswered requests expire and nothing is charged.

The renter pays the daily price set by the host, a Stufflet service fee and any delivery fee. Hosts receive the daily price minus a host fee. All fees are shown before you confirm and are in Canadian dollars unless stated otherwise. Stufflet’s fees pay for the platform; they are not premiums and buy no coverage.

The host sets a refundable deposit for each tool. It is authorized on the renter’s payment method before pickup and released within 24 hours of a clean return, or sooner when the host releases it.

6. Cancellations

Renters may cancel free of charge until 48 hours before the pickup window. Later cancellations forfeit the service fee and up to one day of rental. Hosts who cancel a confirmed booking may be removed from the platform after repeated cancellations.

If a tool is unavailable or materially different from its listing at pickup, the renter may decline the handoff and receive a full refund.

7. Handoff and condition record

At pickup and return, both parties confirm the handoff in the app and record at least four photos of the tool. This record is the primary evidence for any claim. Confirming a handoff means you accept the tool’s condition as recorded.

8. Damage, loss and the deposit

The deposit is the security for the renter’s obligations to the host. If a host reports damage, loss or theft within 48 hours of the return handoff, with photos and an estimate, Stufflet reviews the handoff record and, within a reasonable time, either releases the deposit to the renter or captures all or part of it for the host. Stufflet’s review is an administrative service to settle the deposit. It is not a determination of legal liability between the host and the renter, and either may pursue the other directly.

Stufflet never captures more than the authorized deposit, never charges a renter beyond it, and never pays a claim from its own funds. Any amount above the deposit, and any dispute about it, is solely between the host and the renter, who may resolve it directly or through the courts, including the Small Claims Division of the Court of Quebec.

9. Assumption of risk

Tools and equipment can cause serious injury, death and property damage even when used correctly. Renting to a stranger carries the risk that your property is damaged, lost or stolen. You acknowledge these risks and accept that Stufflet has not inspected any tool, has not assessed any member’s competence, and undertakes no duty to do so.

This acknowledgement does not waive any remedy you have against the person whose fault caused you injury. It records that you were informed of the risks and chose to proceed, which a court may take into account in apportioning responsibility for any injury you suffer.

10. Indemnity

You agree to defend, indemnify and hold harmless Stufflet, its owners, directors, officers, employees and contractors from and against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or connected with your listing, rental, transport or use of a tool, your interactions with other members, your breach of these terms, or your violation of any law or of any third party’s rights. This indemnity does not extend to any loss caused by Stufflet’s own fault.

11. No warranty and limitation of liability

The platform is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement. Stufflet does not warrant that any tool, host or renter meets any standard.

To the fullest extent permitted by law, Stufflet is not liable for personal injury, death, property damage, loss or theft of a tool, lost income or profit, or any indirect, incidental, special, punitive or consequential damages arising from any rental, from the condition or use of any tool, or from the acts or omissions of any member, whether in contract, extra-contractual liability (including negligence) or otherwise. If Stufflet is nonetheless found liable, its total liability to you for all claims is limited to the service fees you paid to Stufflet in the twelve months before the claim arose.

This section does not exclude or limit Stufflet’s liability for bodily or moral injury caused by its own fault, nor for material injury caused by its intentional or gross fault. If you are a consumer, nothing in these terms liberates Stufflet from the consequences of its own acts or those of its representatives. These terms contain no arbitration requirement and do not restrict your right to go before a court or to take part in a class action.

Nothing in these terms limits rights you have under the Quebec Consumer Protection Act, the Civil Code of Quebec or any other law that cannot be excluded by agreement. Where a jurisdiction does not allow a particular exclusion, that exclusion applies to the fullest extent it does allow, and the rest of these terms continues to apply.

12. Prohibited use

You may not list stolen, unsafe or illegal equipment, rent tools to third parties, use the platform to arrange rentals off-platform, harass other members, scrape or reverse engineer the service, or use tools for anything illegal. Stufflet may suspend or close accounts that break these rules.

If you believe a listing is unsafe, inaccurate or unlawful, report it to safety@stufflet.com. Stufflet may remove a listing or suspend an account on a report, at its discretion. Reviewing reports does not make Stufflet an inspector of tools and does not create a duty to find problems that were not reported.

13. Reviews and content

Reviews are only allowed after a completed rental and must be honest. You keep ownership of photos and text you post and grant Stufflet a licence to display them in connection with the service.

14. Changes, termination and governing law

We may update these terms and will notify you in the app or by email at least 14 days before material changes take effect. You may close your account at any time; bookings in progress remain subject to these terms.

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein. Subject to any law that provides otherwise, disputes are heard in the courts of the district of Vaudreuil-Soulanges.

A French version of these terms is provided to members in Quebec. If the French and English versions differ, the French version prevails for members in Quebec.
